In determining whether the statements of a witness are testimonial or nontestimonial for purposes of the Sixth Amendment’s Confrontation Clause, the Court of Criminal Appeals must consider such factors as whether each statement: (1) was in response to a law enforcement or prosecutorial inquiry; (2) involved more than a routine and objective cataloging of unambiguous factual matters; and (3) was made primarily to produce evidence with an eye toward trial.
