A military court-martial conviction is generally considered a “felony conviction,” if the maximum permissible punishment for the offense is one year or more in prison. Thus, it is not a question of what sentence is actually imposed at court-martial but rather what is the maximum punishment for the offense. Consequently, it will depend on the specific offense and what type of court-martial you are facing. If your case is being adjudicated at the Summary court-martial level, then the maximum punishment that can be awarded is 30 days, regardless of the offense. Special court-martials can impose sentences of up to one year, and general court-martials can impose any proscribed sentence, up to the maximum punishment listed for the particular offense in the Manual for Courts-Martial (MCM).
