Kahanamoku ,327 U.S. 304, 66 S.Ct. 606 U.S. (1946), the court observed that, “the phrase “martial law” within provision of the Hawaiian Organic Act authorizing the territorial Governor with approval of the President to proclaim martial law in the interest of public safety, while intended to authorize the military to act vigorously for the maintenance of an orderly civil government and for the defense of the Island against actual or threatened rebellion or invasion was not intended to authorize the supplanting of courts by military tribunals.”
