In Caldwell v. Parker, 252 U.S. 376, 40 S.Ct. 388 U.S. (1920), the court observed that, “Articles of War of 1916, art. 92, 39 Stat. 664, providing for punishment of murder or rape as a court-martial may direct, but prohibiting trial by court-martial in time of peace, article 93, providing for the punishment of various other offenses as a court-martial may direct, and article 74, requiring military authorities to deliver accused persons to the civil authorities, except in time of war, do not give military courts exclusive jurisdiction in time of war of offenses committed in violation of state laws by persons in the military service, and a state court has jurisdiction of such offenses.
