In Hamdan v. Rumsfeld, 126 S.Ct. 2749 U.S.,(2006), the court observed that, “Article of the Uniform Code of Military Justice, indicating that those provisions of the Code conferring jurisdiction on the courts-martial shall not be construed as depriving military commissions of concurrent jurisdiction that they possess with respect to offenders or offenses that, by statute or by law of war, may be tried by such commissions, is not sweeping mandate for the President to invoke military commissions as he deems appropriate, but at most preserves what power, under the Constitution and common law of war, the President had to convene such commissions, upon express condition that the President and those under his command comply with law of war.”
The court further observed that, “Uniform Code of Military Justice (UCMJ) conditions the President’s use of military commissions on compliance not only with the American common law of war, but also with the rest of the UCMJ itself, insofar as applicable, and with the rules and precepts of law of nations, including, inter alia, the four Geneva Conventions.”
