In Hamdan v. Rumsfeld 126 S.Ct. 2749 U.S.,(2006), the court observed that, “Alien could invoke Geneva Conventions to challenge procedures used by military commission in his trial; Conventions were part of the law of war, and compliance with the law of war was condition upon which courts-martial authority was granted”. UCMJ, Art. 21, 10 U.S.C.A. § 821.
Further the court observed that, “even if al Qaeda was not signatory of Geneva Conventions, alien captured in connection with United States’ war with al Qaeda was entitled to protection of article of Geneva Conventions prohibiting “the passing of sentences and the carrying out of executions without previous judgment pronounced by a regularly constituted court affording all the judicial guarantees which are recognized as indispensable by civilized peoples”; conflict with al Qaeda was a “conflict not of an international character” within meaning of article, which afforded some minimal protection to individuals associated with neither a signatory nor even a nonsignatory “Power” who were involved in a conflict “in the territory of” a signatory.”
