In U. S. ex rel. Toth v. Quarles, 350 U.S. 11, 76 S.Ct. 1 U.S. (1955), the court observed that, “Fifth Amendment provision that no person shall be held to answer for capital or otherwise infamous crime unless on presentment or, indictment of grand jury, except in cases arising in land or naval forces, or in militia, when in actual service in time of war or public danger, does not grant court-martial power to Congress, but merely makes clear that there need be no indictment for such military offenses as Congress can authorize military tribunals to try under its power to make rules to govern armed forces.” Uniform Code of Military Justice, arts. 3(a), 77-134, 94(2, 3), 50 U.S.C.A. §§ 553, 671-728, 688(2, 3); U.S.C.A.Const. art. 1; Amend. 5.
