U.S., 510 U.S. 163, 114 S.Ct. 752 U.S.,(1994), the court observed that, “Military judges, who had already been commissioned as military officers before being assigned to serve as judges, did not have to receive another appointment before assuming judicial duties; position of military judge was not so different from other positions to which officer could be assigned that Congress by implication required second appointment under appointments clause.”
