Board of Inquiry Hearings
An officer who is facing a potential separation from the military is entitled under military law to an Inquiry Board Hearing. In an Inquiry Board Hearing, a panel of officers will hear the facts & evidence presented regarding the basis for the potential separation & then provide the general officer or admiral in command of making the final decision, the panel’s recommendation regarding the officer’s future in the military. Due to the higher standard of excellence military officers are required to uphold, an officer whose conduct is deemed inappropriate may face a potential discharge or retirement from the military. Unfortunately, the involuntary retirement may be at a lower rank.
- Court-martial allegations (even if not convicted)
- Commission of a serious offense (other courts-martial)
- Civilian conviction (outside of military)
- Conduct unbecoming of an officer
- Substandard performance of duty
- Military misconduct
- Other UCMJ violations
