Recall to Duty – Exemptions

Military personnel who are part of the Individual Ready Reserve (IRR) are subject to recall to active duty for up to a year. Physical Evaluation Boards

When a military member has a medical condition (including mental health conditions) which renders them unfit to perform their required duties, they may be separated (or retired) from the military for medical reasons. The process to determine medical fitness for continued duty involves two boards — One is called the Medical Evaluation Board (MEB), and the other is called the Physical Evaluation Board (PEB).

If the MEB determines that the member has a medical condition which is incompatable with continued military service, they refer the case to a Physical Evaluation Board (PEB). The PEB is a formal fitness-for-duty and disability determination that may recommend one of the following:

  • Return the member to duty (with or without assignment limitations, and or medical re-training)
  • Place the member on the temporary disabled/retired list (TDRL)
  • Separate the member from active duty, or
  • Medically retire the member

Board Inquiry Hearings Officer Military Law Separation Lawyer Court Martial Discharge UCMJ Misconduct

Board of Inquiry Hearings

An officer who is facing a potential separation from the military is entitled under military law to an Inquiry Board Hearing. In an Inquiry Board Hearing, a panel of officers will hear the facts & evidence presented regarding the basis for the potential separation & then provide the general officer or admiral in command of making the final decision, the panel’s recommendation regarding the officer’s future in the military. Due to the higher standard of excellence military officers are required to uphold, an officer whose conduct is deemed inappropriate may face a potential discharge or retirement from the military. Unfortunately, the involuntary retirement may be at a lower rank.

  • Court-martial allegations (even if not convicted)

A person in the military could face an involuntary separation and even an administrative board for a variety of reasons such as :

When are you entitled to a hearing before an Administrative Separation Board

Military personnel that has been enlisted for more than six years are entitled to an administrative separation board hearing. Military personnel that may be on the verge of receiving an Other Than Honorable discharge (OTH).

If a person in the military has less than six years of service, then they are not entitled to an administrative separation board hearing.

 

What is an Administrative Separation Board

A hearing before an administrative separation board will be a hearing before three officers who will hear all the facts and evidence regarding the reasons for an involuntary separation, and then they will make a recommendation to the admiral or general officer who will make the final call as to whether the individual will be discharged or not. In addition, the three panel board will also recommend what type of discharge should be awarded if the panel makes a recommendation for a discharge.
