WHAT IS AN ARRAIGNMENT?
An arraignment is a procedural tool to inform an accused of the charges against him. Additionally, the accused, at this stage, is offered an opportunity to make a plea (i.e., “guilty” or “not guilty”). If an accused intends to plead guilty, the military judge must ensure that the accused understands what he is doing, what rights he is forfeiting and is acting knowingly and voluntarily. The military refers to this as a “providency inquiry.” This same requirement exists in the civilian courts; however, the military inquiry is usually more extensive and more fact-specific to the offenses.
